    If/when Trump elects a replacement before the November election, it's going to wipe out any chance the Dems have of trying to contest the election.

    Unless you believe Biden is going to be elected, there won't be a new president after this election. You'd have to wait 4 more years for that to happen. So we're supposed to have 8 Supreme Court justices until Trump is no longer president? Absolutely laughable.

    ^^ the beauty of the hypocrisy from both sides is knowing the GOP did, and will, win this. Dems were better off staying true to their past position. Gonna lose. Might as well stay consistent.

    The GOP plays by their own rules and bends them as it suits them. Nothing the dems can do in this case except hope they can get some GOP senators to flip. Romney and Murkowski seem like they will, no other safe bets aside from those two.

    If they're gonna push a nominee through after preaching the exact opposite in 2016, then the dems better pack the court if they win the WH and senate. But it's the dems so they'll just go nothing while the GOP continues to play dirty

    Mitch is doing what he promised GOP donors that he would do. Stack the courts with conservative judges. You think the Dems won't do the same thing if they were in his position? Both parties serve the donor class. Harry Reid removed the filibuster in 2013 so the Dems could do the same thing Mitch is doing now. Ginsberg was 80 years old that year. She should have retired and allowed Obama to appoint her successor. In eight years, Obama only appointed 2 supreme court justices. Trump is on his way to appoint 3 justices in 4 years.

    C'mon man. Both sides play dirty. If this situation was reversed they'd be doing the exact same thing. Let's not pretend one side is a beacon of righteousness while the other are Nazis. Both sides play dirty. Both sides suck.

    I'm not normally a fan of Karl Denninger and his Market Ticker blog. But this one fits to a T.

    I'll call this an "own goal" on the Democrats' part. She should have allowed Obama to appoint her successor and then the Democrats wouldn't be in this fix now.

    The Democrats are stuck making mostly empty threats as there is zero precedent, that's right, zero precedent in US history for a President and a Senate majority of the same party to not nominate and confirm a new Justice in the year of a presidential election.

    Court packing? One ought to study what happened the last time that was attempted. In 1936, FDR and the Democrats enjoyed an unprecedented landslide election outcome that saw them controlling both Houses with veto-proof and filibuster-proof majorities. So FDR in his pride and hubris thought the moment was right for striking back at the Supreme Court that had knocked down some of his more radical programs during his previous term. He announced his proposal just days after his inauguration in 1937 and it was almost literally dead on arrival as many in his own party as well as the opposition came out against it. By summer that year, FDR was forced to give up on it, but the damage was done as the Republicans stormed back in the 1938 midterm elections and came close to taking control back.
